Terms & conditions
These terms apply when you browse or buy from Kella + Co through https://kellaco.nz. The contract is with Kumara Acoustics Limited trading as Kella + Co. By using this shop you agree to these terms. Please read them with our Shipping, Returns, and Privacy policies.
About us
Legal entity: Kumara Acoustics Limited.
Trading as: Kella + Co (Kella + Co).
Address: New Zealand.
Contact: our contact details on this website.
We sell second-hand fashion and related items. Unless stated otherwise, each listing is for one unique piece.
Using this website
You must be legally able to enter a contract in New Zealand (generally 18 or over, or with a parent/guardian’s involvement).
Do not misuse the site (for example attempting fraud, scraping, or interfering with security). We may restrict access if we reasonably believe there is abuse.
We try to keep information accurate but listings are prepared manually. If we discover a material error, we will correct it and contact you if you have already ordered.
Listings, availability & other platforms
Photos and descriptions are part of the product information. Colours may vary slightly depending on your screen.
Some items appear on our shop for browsing while being sold on Trade Me or Designer Wardrobe. Only items enabled for Kella shop checkout can be purchased here.
Because stock is unique, an item may sell on another channel before checkout completes. If that happens, we will cancel your order and refund payment.
Orders & contract formation
Displaying an item is an invitation to buy, not a binding offer.
When you complete checkout (including payment authorisation through Stripe), you make an offer to buy at the prices shown.
We accept your offer when we confirm the order (typically by email/receipt and by dispatching the item). We may decline an order before dispatch (for example if the item is unavailable or we suspect fraud).
We may cancel an order and refund payment if we made a manifest pricing or listing error.
Prices & payment
All prices on this shop are shown in New Zealand dollars (NZD) and include goods and services tax (GST) at the applicable rate.
Payment is processed by Stripe. We do not store your full card number on our servers.
You must pay the total shown at checkout (item price plus shipping and any applicable charges).
A tax invoice or receipt is available after purchase (online receipt page and PDF where provided).
Shipping & delivery
Delivery terms are set out on our Shipping page, which forms part of these terms.
We ship to New Zealand addresses only unless we clearly agree otherwise in writing.
Consumer guarantees & fair trading
Nothing in these terms limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those laws apply to you as a consumer.
Where the CGA applies, certain warranties cannot be excluded. Our Returns page explains how we handle faulty or misdescribed goods.
If you acquire goods for business purposes and the CGA is excluded by law, different remedies may apply — contact us if that is your situation.
Limitation of liability
To the fullest extent permitted by law, our liability for any claim in connection with a product or this website is limited to the price you paid for the relevant item (or the value of the order, if the claim relates to the order as a whole).
We are not liable for indirect or consequential loss (for example lost profit or wasted time) except where such limitation is not permitted by law.
Nothing in these terms affects liability that cannot be limited under New Zealand law, including rights and remedies under the CGA where it applies.
Privacy & electronic communications
Our Privacy policy explains how we handle personal information.
You agree to receive transactional messages about your order (for example confirmations and delivery-related contact) by email or other details you provide.
We do not send marketing email unless you opt in separately.
Changes, governing law & disputes
We may update these terms from time to time. The “Last updated” date on this page shows the current version. Continued use after changes means you accept the updated terms for new orders.
These terms are governed by the laws of New Zealand.
Disputes should first be raised with us directly. If unresolved, you may use the Disputes Tribunal or courts of New Zealand where you qualify to bring a claim.
